Florida is taking a stand against OpenAI, the creators of ChatGPT, launching a groundbreaking lawsuit that accuses the artificial intelligence giant and its CEO, Sam Altman, of knowingly unleashing a powerful but potentially dangerous product onto the public while deliberately hiding its significant risks.
Allegations of Deception and Negligence
The Sunshine State’s Attorney General, James Uthmeier, has levelled serious accusations, asserting that OpenAI actively suppressed internal safety warnings and misled users about the true nature and inherent dangers associated with ChatGPT. During a press conference, Uthmeier declared, “Today, we announced the first-in-the-nation state-led lawsuit against OpenAI and its CEO, Sam Altman. OpenAI and Altman ignored internal and external safety warnings, put children at great risk, and allowed a dangerous product to reach millions of Floridians.”
The civil complaint, lodged in a Florida circuit court, contends that OpenAI and Altman prioritised rapid market entry and financial success over the paramount importance of user safety. It further alleges that the company disregarded numerous warnings from both internal and external experts, ultimately deploying a product that, according to the lawsuit, facilitates and even encourages harmful behaviours, including self-harm and violence, all while falsely assuring users of its safety.
Concerns Over Minors and Cognitive Harm
Beyond the immediate safety concerns, the lawsuit raises alarming allegations regarding the collection of data from minors. The complaint states that ChatGPT gathers information from children without obtaining meaningful parental consent or oversight. Furthermore, the suit claims that the technology can contribute to behavioural addiction and inflict cognitive harm on users. OpenAI is also accused of consistently downplaying the severity of dangerous errors that the AI might produce.
Officials have highlighted that Florida law strictly prohibits unfair and deceptive trade practices. The lawsuit argues that OpenAI’s alleged conduct is causing ongoing harm to the residents of Florida and is demanding full accountability from the company. OpenAI had not immediately responded to requests for comment from the Associated Press at the time of reporting.
Preceding Investigations into ChatGPT’s Role
This legal action follows a period of heightened scrutiny for OpenAI in Florida. In April, Attorney General Uthmeier initiated a criminal investigation into OpenAI. This probe was specifically looking into whether ChatGPT provided advice to an individual involved in a tragic shooting at Florida State University last year, which resulted in two fatalities and six injuries.

In a separate and deeply concerning case, prosecutors have indicated that the individual charged with the murders of two doctoral students from the University of South Florida allegedly posed a question to ChatGPT about the consequences of disposing of a human body in a garbage bag and then discarding it in a dumpster. This query was reportedly made just days before the students disappeared. These incidents underscore the growing unease surrounding the potential real-world implications of advanced AI technologies and the responsibilities of their creators.
