Asbestos Mulch Scandal: Infrastructure Giants Fined, State-Wide Contamination Crisis Unfolds
A significant environmental crisis, triggered by the delivery of asbestos-contaminated mulch to Sydney’s Rozelle Parklands, has resulted in infrastructure giant John Holland and its joint venture partner, CPB Contractors, agreeing to pay $150,000. This landmark penalty, part of a legally binding enforceable undertaking with the NSW Environment Protection Authority (EPA), aims to bolster worker training in the safe handling of asbestos. The scandal, which erupted in early 2024, led to the temporary closure of dozens of schools, parks, and hospitals across New South Wales due to widespread contamination.
While John Holland and CPB Contractors were not the original producers of the tainted mulch, their role in managing the Rozelle Parklands project, an interchange atop a motorway junction, placed a responsibility upon them to ensure that contaminated materials were not brought onto the site. Tony Chappel, the EPA’s chief executive, emphasised this point, stating, “While we acknowledge the joint venture did not produce the mulch, they delivered the interchange project so had a responsibility to ensure that contaminated material was not brought onto the site as part of those works.” He expressed satisfaction that the undertaking would lead to enhanced training for individuals working with asbestos sources, thereby minimising the risk of such materials entering recycling and waste streams. John Holland Group has thus far declined to comment on the matter.
The enforceable undertaking represents a resolution of alleged environmental law breaches without resorting to formal court prosecution. This particular case is distinct from the 102 prosecutions initiated by the EPA in December 2024, which are specifically targeting the alleged originators of the asbestos-laden mulch.
Unravelling the Source: Investigations and Charges
The investigation into the source of the contaminated mulch has been extensive, with the EPA launching its largest-ever investigation into the matter. Several entities and individuals are facing charges in connection with the widespread contamination.
Arnold Vitocco: A prominent figure in the property development and business world, Arnold Vitocco, also known as the owner of the Max Brenner chocolate cafe chain, has been charged with an executive liability offence. This charge is linked to an alleged breach of an environmental protection licence by VE Resource Recovery, a company in which he served as a director.
Greenlife Resource Recovery Facility: Two entities operating under the name Greenlife Resource Recovery Facility, namely Freescale Trading Pty Ltd and Runkorp Pty Ltd, are facing charges for allegedly reusing asbestos waste. This conduct is said to have breached a resource recovery order and involved carrying out scheduled activities without the necessary licence.

The charges brought forth by the EPA relate to asbestos being found mingled with mulch at 26 of the 79 affected sites across New South Wales. Greenlife Resource Recovery Facility has stated that it is contesting these charges, and the case is presently before the courts.
Remediation and Ongoing Vigilance
Despite the significant disruption and concern caused by the contamination, the Rozelle Parklands site has since been fully remediated and was reopened by April 2024. The incident has highlighted critical gaps in regulatory oversight and the importance of stringent supply chain management within the construction and waste management industries.
The EPA’s extensive investigation and subsequent actions underscore the seriousness with which the contamination of public spaces with hazardous materials is being treated.
